2. Makepix Accounts

• Eligibility: Users must be at least 18 years old and legally capable of entering into a binding agreement.
• Account Use: Sharing accounts is prohibited. Users are responsible for maintaining the confidentiality of their account credentials and for all activity on their account.
• Termination: We reserve the right to suspend or terminate accounts for violations of these Terms. Termination does not entitle you to a refund.
• No Data Recovery: Upon termination of your account, all associated data may be permanently deleted.

3. Subscription and Billing

• Subscription Plans: Our Services are offered on a subscription basis with various plans, including weekly subscriptions. Plan details, pricing, and benefits are available on our website.
• Free Trials: Some subscription plans may include a trial period (e.g., 3 days), which provides limited-time access to premium features. Trials must be canceled before expiration to avoid charges.
• Billing Cycle: Subscriptions automatically renew at the end of each billing period unless canceled.
• No Refund Policy: All payments are final and non-refundable, except where required by law. This includes subscriptions and charges incurred due to failure to cancel before the next billing cycle.
• Negative Option Billing: By subscribing, you acknowledge and agree to our automatic renewal feature. You will be charged automatically unless you cancel through your account settings before the renewal date. Clear instructions for managing subscriptions and cancellations are available in your account.

4. User Responsibility and Generated Content

• Ownership: Users retain rights to the images they generate using Makepix. We do not claim ownership of user-generated content.
• Content Standards: Users are fully responsible for all content generated through our Services. You agree not to use our Services to create, share, or distribute content that is:
  • Illegal, harmful, defamatory, or otherwise violates applicable laws or regulations.
  • Infringing on third-party intellectual property rights.
  • Obscene, explicit, or intended to exploit individuals.
• Compliance: You are responsible for ensuring that your use of Makepix complies with all applicable laws and regulations in your jurisdiction.
• Indemnity: You agree to indemnify and hold Makepix harmless from any claims, liabilities, or damages arising out of or related to your content.

5. No Warranty and Limitation of Liability

• Service Availability: Makepix is provided "as-is" without warranties of any kind. We do not guarantee uninterrupted access or compatibility with all devices or systems.
• Disclaimer: To the fullest extent permitted by law, we disclaim liability for any indirect, incidental, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Services.
• User Responsibility: Users bear all risks associated with the generation, use, or dissemination of content created through our platform.

6. Conduct and Restrictions

• Prohibited Activities: Users must not misuse the Services. This includes:
  • Hacking, modifying, or reverse-engineering the platform.
  • Generating or distributing harmful, offensive, or prohibited content.
  • Violating any third-party rights or applicable laws.
• Enforcement: Makepix reserves the right to suspend or terminate accounts and remove content violating these Terms.
