1. Acceptance of Terms

By accessing, browsing, or using the Makepix website, software application, or any services offered by Makepix ("Service"), you acknowledge and agree to be bound by these Terms of Service ("Terms") without modification, which form a legally binding contract between you and Makepix. These Terms govern your access to and use of Makepix and its image generation and posting services.
  2. Use of the Makepix services constitutes acceptance of these Terms by default. If you do not agree to these Terms, you are not authorized to use the Makepix services. You must discontinue use immediately and are required to delete your account if it has been created.
  3. Questions or concerns regarding these Terms should be directed to support@makepix.ai.

2. Makepix Accounts and Services

  1. To access the image generation and posting functionalities of Makepix, users are required to create an account.
  2. Users must be at least 18 years old and legally capable of entering into a contract to use Makepix.
  3. Account sharing is prohibited. Maintain the confidentiality and security of your account information.
  4. Account holders are accountable for all activities conducted through their account. Compliance with these Terms is mandatory.
  5. Makepix reserves the right to terminate accounts found in violation of these Terms.
  6. Upon account termination, Makepix does not guarantee data recovery or refund any transactions.
  7. While we strive for high service reliability, Makepix does not guarantee uninterrupted service. The compatibility of Makepix with third-party applications and devices is not guaranteed and may be governed by third parties' terms and conditions.
  8. Makepix disclaims all liability for damages arising from your use of our service or the images generated.
  9. Makepix may revise these Terms at any time. Users will be notified of any significant changes.

3. Financial Transactions

  1. Purchases and subscriptions provide users with Makepix credits, enabling access to premium functionalities.
  2. Credits are exclusively for image generation on Makepix and are non-refundable and non-transferable.
  3. Subscriptions may be terminated at any time. Access to premium functionalities will continue until the end of the current billing cycle.
  4. Subscription fees are denominated in US Dollars. Listed prices do not include taxes, which are assessed by our payment processor.
  5. Failure to renew subscriptions may result in service termination.

4. Generated Content

  1. Makepix claims no ownership over images generated by users, who are free to use such content for both commercial and non-commercial purposes.
  2. The AI's outputs can be unpredictable and may not align with input prompts. Makepix is not responsible for the nature or quality of generated images.
  3. Users must not generate content that is illegal or violates any laws in their jurisdiction.
  4. Access to Makepix must be through the official website or software application. Contact support@makepix.ai for API access inquiries.
  5. Generated content should not substitute professional advice or services.

5. User Data and Privacy

  1. Makepix respects your privacy and commits to securing your personal information. Only essential data for service provision is collected and stored.

6. Conduct and Content

  1. Users agree to not misuse Makepix services. This includes refraining from unauthorized modifications, using the service for illegal activities, uploading harmful or illegal content, and any actions that could harm Makepix or its users.
  2. Content uploaded to Makepix must not violate any laws or third-party rights. Users are responsible for ensuring their content complies with these standards.
  3. Makepix reserves the right to remove content or terminate accounts that violate these Terms.

7. Disclaimer and Limitation of Liability

  1. Makepix is provided on an "as-is" basis without warranty of any kind. We disclaim all warranties, express or implied, to the extent permitted by law.
  2. Makepix will not be liable for any indirect, special, incidental, or consequential damages arising out of or in connection with the use of our service.

8. Amendments

  1. These Terms may be updated periodically. Users will be informed of any significant changes. Continued use of Makepix after such changes constitutes acceptance of the new Terms.
